New Delhi: Family members of Central government employees have many times faced confusion regarding family pension, whether a member is eligible for 2 pensions from different sources of the same pensioner. In view of this, the Department of Pension and Pensioners’ Welfare (DoPPW) recently issued a clarification.
In an Office Memorandum dated May 23, 2022, the department stated that there is no restriction on the grant of family pensions from two different sources under the Central Civil Services (Pension) Rules 2021. The DoPPW noted that this position was also clarified on January 16, 2013.
Rule 50 of the Central Civil Services (Pension) Rules, 2021 deals with family pension and does not provide for any restriction on grant of family pension from 2 different sources in respect of the same government servant/pensioner.
“It is clarified that there is no restriction in the Central Civil Services (Pension) Rules, 2021 on grant of family pension to a family member from two different sources in respect of the same Government servant/pensioner,” the DoPPW said in the circular.
It, however, added that the entitlement of 2 family pensions to a member of the family consequent on death of 2 different government servants/pensioners shall continue to be subject to the restriction in sub-rule 12(a) and sub-rule 13 of Central Civil Services (Pension) Rules, 2021.
It may be noted here that the Centre had notified the Central Civil Services (Pension) Rules, 2021 on December 20 last year replacing the erstwhile Central Civil Services (Pension) Rules, 1972.
